WE COLLECT INFORMATION FROM AND ABOUT YOU
My/Mochi obtains information about you when you visit our Website. Please note that we need certain types of information so that we can provide our Products to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use all or part of our Website.
1. Information You Voluntarily Provide to Us
My/Mochi collects information directly from you in a variety individuals, including:

Our Workforce and Job Applicants
We collect and retain the types of professional or employment related personal information you would expect an employer to have about its existing and former workforce and new job applicants. We provide legally required notices of collection, and describe our use and sharing of the personal information of our workforce and applicants in greater detail in confidential internal human resource manuals and documents accessible to members of our workforce, or by publication on the proprietary workforce/applicant portals and apps we operate. In some cases, such portals and apps may be operated by third parties who transfer the personal information to us. In those situations, the legal responsibility to provide notice usually rests with the third party, not us.

My/Mochi and our services providers (third-party companies that work on our behalf) use a variety of technologies to assist in collecting information about your use of our Website and the devices you use to access our Website.

In addition to using web beacons on web pages, we also use web beacons in email messages sent to individuals listed in My/Mochi’s database.
Other Online Tools. My/Mochi may also use a web server log or an SDK. A webserver log is a file where website activity is stored. An SDK is a set of tools and/or code that we embed in our software to allow third parties to collect information about how people interact with our Services.

My/Mochi maintains a presence on a variety of social media platforms. When you “like” or “follow” us on Facebook, Instagram, Twitter, or other social media platforms, we may collect some information about you. We also collect your information if you sign up for a promotion and/or submit information to us through one of our social media accounts.

My/Mochi also maintains a blog as a part of our Website. When you comment or post content to any of our blog, we will collect your name and email address.

1. Email Marketing
By submitting your email address through our Website, you are expressly consenting to receive emails from My/Mochi, including from My/Mochi’s affiliates, and from third parties concerning offers and advertisements unrelated to My/Mochi. 2. Online Advertising
Our Website may integrate third-party advertising technologies (e.g., ad networks and ad servers such as Facebook, Google Ad Words, Criteo and others) that use cookies and other technologies to deliver relevant content and advertising for products on our Website, as well as on other websites you visit and other applications you use. 3. Data Analytics
We may use third-party web analytics services (such as those of Google Analytics (including Google Signals, Google User-ID, and other Google Analytics features) and MixPanel) on our Website to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; try to locate the same unique users across multiple browsers or devices to better tailor services and features; and provide certain features to you. 4. Mobile Advertising
We do not provide mobile phone applications for our Website or Products. However, when using mobile applications from others and third-parties, you may also receive tailored in-application advertisements. We may use third-party service providers to deliver advertisements on mobile applications or for mobile application analytics. Each operating system, iOS for Apple phones, Android for Android devices, and Windows for Microsoft devices provides its own instructions on how to prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform operator allows you to control receiving personalized in-application advertisements; thus, you should contact the platform provider for further details on opting out of tailored in-application advertisements. 5. Notice Concerning Do Not Track
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. My/Mochi’s Website provides hypertext links to the websites of third-party retailers from whom you can purchase our Products. My/Mochi is not responsible for the privacy practices or the content of such other websites. Such links are provided for your convenience and reference only. My/Mochi does not operate or control in any respect any information, software, products or services available on such third-party websites. HOW WE PROTECT DATA
We will implement reasonable and appropriate security procedures consistent with prevailing industry standards to protect data from unauthorized access by physical and electronic intrusion. Unfortunately, no data transmission over the Internet or method of data storage can be guaranteed 100% secure. Therefore, while we strive to protect your personal information by following generally accepted industry standards, we cannot guaranty, ensure or warrant the absolute security of any information you transmit to us or archive through the Website. Our website does not allow you to create an account or provide credit information for purchasing our products through the website. That is not information we have access to or keep.
SUBMITTING INFORMATION FROM OUTSIDE THE UNITED STATES
We control and operate our Website from within the United States of America (the “U.S.”). Information collected through our Website may be stored and processed in the United States or any other country in which we or our vendors maintain facilities. Although we do not actively block or monitor visitors from other countries, our Website is directed only at visitors from the U.S. As such, this Privacy Policy is consistent with U.S. law and practice and is not adapted to other laws (including European data security and privacy laws).
My/Mochi will apply the applicable laws of the U.S., including those embodied in this Privacy Policy, in place of data protections under your home country’s law. That is, you freely and unambiguously acknowledge that this Privacy Policy, not your home country’s laws, controls how we will collect, store, process, and transfer your personal information. Similarly, the English language version of this Privacy Policy is the controlling version regardless of any translation you may attempt.
THE CALIFORNIA CONSUMER PRIVACY ACT
When we collect personal information from California residents we become subject to, and those residents have rights under, the California Consumer Privacy Act or “CCPA”. This section of our policy is used to allow us to fulfill our CCPA obligations and explain your CCPA rights. For purposes of this section, the words “you” and “your” mean only such California residents.

We collected the following categories of personal information within the last 12 months for visitors to our website and job applicants:

Similarly, we urge you to re-read this part of this policy where we describe the categories of third parties with which we may share your personal information and why. We do not sell, and within the last 12 months have not sold, personal information to third parties.
2. Rights of California Residents
You have the following rights under the CCPA. It is important to us that you know that if you exercise these rights, we will not “discriminate” against you by treating you differently from other California residents who use our sites and mobile resources or purchase our services but did not exercise their rights.

The CCPA only allows us to act on your request if we can verify your identity or your authority to make the request so you will also need to follow our instructions for identity verification.
If you make a verifiable request per the above, we will confirm our receipt and respond in the time frames prescribed by the CCPA.
CHILDREN’S PRIVACY
Federal law imposes special restrictions and obligations on commercial website operators who direct their operations toward, and collect and use information from children under the age of 13.
My/Mochi takes those age-related requirements very seriously, and, consistent with them, do not intend for our Website to be used by children under the age of 18. Moreover, we do not knowingly collect personal information from minors under the age of 18. If we become aware that anyone under the age of 18 has submitted personal information to us via our Website, we will delete that information and not use it for any purpose whatsoever. We encourage parents and legal guardians to talk with their children about the potential risks of providing personal information over the Internet.
